Terms of Service

Effective date: 4/2/2026 Last updated: March 31, 2026

These Terms of Service (“Terms”) govern your access to and use of the Koleslaw prompt enhancement service, including the website and chat interface at https://koleslaw.ai (the “Site”), the Koleslaw Chrome extension (the “Extension”), the Koleslaw API at api.koleslaw.ai (the “API”), and any related tools, documentation, or interfaces (collectively, the “Service”). The Service is operated by Thunk About It (“Koleslaw,” “we,” " us," or “our”).

The Site’s chat box and the Extension both communicate with the same backend API. These Terms apply equally to all methods of accessing the Service.

By accessing or using the Service through any interface, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are between 16 and 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We do not knowingly provide the Service to children under 16. If we learn that a user is under 16, we will terminate their access and delete any associated data.

2. Description of the Service

Koleslaw is an AI-powered prompt enhancement service. You submit text prompts through the Site’s chat box, the Extension’s popup interface, or directly through the API, and the Service processes your input using artificial intelligence models to return an enhanced version of your prompt.

All three interfaces — the Site, the Extension, and the API — send your prompts to the same backend at api.koleslaw.ai for processing. The enhancement functionality is identical regardless of which interface you use.

The Service is provided as a tool to assist you. The output generated by the Service is machine-produced and may contain errors, inaccuracies, or content that does not meet your expectations. You are solely responsible for reviewing, editing, and validating any output before using it for any purpose.

3. Accounts and API Access

3.1 Account Registration

Certain features of the Service may require you to create an account on the Site or obtain an API key. When you register, you agree to provide accurate, current, and complete information and to keep that information up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials, session tokens, and API keys. You are responsible for all activity that occurs under your account, whether or not you authorized it. This includes activity originating from the Site, the Extension, or direct API calls authenticated with your credentials. You agree to notify us immediately at [email protected] if you become aware of any unauthorized use of your account or API key.

3.3 API Key Usage

Your API key is personal to your account and must not be shared, published, or embedded in publicly accessible code or client-side applications. We reserve the right to revoke any API key that we reasonably believe has been compromised or is being misused.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. The following restrictions apply regardless of whether you access the Service through the Site, the Extension, or the API. You agree not to use the Service to:

  • Submit, process, or generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
  • Submit protected health information (PHI) as defined by the Health Insurance Portability and Accountability Act (HIPAA). The Service is not HIPAA-compliant, and we do not enter into Business Associate Agreements.
  • Submit content that infringes or misappropriates any third party’s intellectual property rights, privacy rights, or other legal rights.
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code, algorithms, or model weights underlying the Service.
  • Probe, scan, or test the vulnerability of the Service or any related system or network, or breach any security or authentication measures.
  • Use the Service to develop competing products or services, or to benchmark the Service for competitive purposes without our prior written consent.
  • Use automated means (bots, scrapers, or similar tools) to access the Site or Extension in a manner that exceeds reasonable use or circumvents rate limits. Programmatic access is permitted only through the API in accordance with its documentation and applicable rate limits.
  • Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
  • Use the Service to generate content intended to deceive, defraud, or manipulate others, including but not limited to phishing, social engineering, disinformation, or academic dishonesty in violation of applicable institutional policies.
  • Circumvent, disable, or interfere with any usage limits, rate limits, or access controls applied to your account, whether on the Site, the Extension, or the API.

We reserve the right to suspend or terminate your access to the Service — across all interfaces — if we reasonably determine that you have violated this section.

5. Your Content

5.1 Ownership

You retain all rights, title, and interest in the text and prompts you submit to the Service (“Your Content”), regardless of whether you submit them through the Site, the Extension, or the API. Submitting content to the Service does not transfer ownership of that content to us.

5.2 License to Koleslaw

By submitting Your Content to the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to process, transmit, and temporarily cache Your Content solely for the purpose of providing the Service to you. This license terminates when Your Content is deleted from our systems in accordance with our data retention practices described in our Privacy Policy.

5.3 Enhanced Output

The enhanced prompt output generated by the Service (“Output”) is provided for your use. Subject to any underlying rights in Your Content, you may use the Output for any lawful purpose. We do not claim ownership of the Output.

However, because AI-generated content may not be eligible for copyright protection in all jurisdictions, and because similar inputs may produce similar outputs for different users, we do not and cannot guarantee that any Output is unique to you or that you will have exclusive rights to it.

5.4 No Training on Your Content

We do not use Your Content to train, fine-tune, or improve our AI models unless you explicitly opt in to such use through a separate, clearly identified consent mechanism. Temporary caching for performance purposes, as described in our Privacy Policy, does not constitute model training. This commitment applies to all prompts submitted through the Site, the Extension, and the API.

6. Intellectual Property

6.1 Our Intellectual Property

The Service — including the Site, the Extension, the API, underlying software, algorithms, models, documentation, branding, logos, and all related intellectual property — is and remains the exclusive property of Koleslaw and its licensors. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.

6.2 Trademarks

“Koleslaw,” the Koleslaw logo, and any other trademarks, service marks, or trade names displayed on the Service are the property of Koleslaw or their respective owners. You may not use our trademarks without our prior written permission.

6.3 Feedback

If you provide us with feedback, suggestions, or ideas about the Service (“Feedback”), you grant us an unrestricted, irrevocable, perpetual, royalty-free license to use, modify, and incorporate that Feedback into the Service without any obligation to you.

7. Third-Party Services and Custom API Endpoints

7.1 Third-Party Integrations

The Service may integrate with or rely on third-party infrastructure, AI model providers, and cloud services to process your prompts. These sub-processors are listed in our Privacy Policy. We are responsible for ensuring that sub-processors handle your data in accordance with our privacy commitments.

7.2 Custom API Endpoints (Extension Only)

The Extension allows you to configure a custom API endpoint instead of api.koleslaw.ai. If you direct the Extension to send your data to a third-party endpoint, you acknowledge that:

  • We have no control over and assume no responsibility for the content, privacy practices, or policies of any third-party endpoint.
  • Your use of third-party endpoints is at your sole risk and governed by that third party’s terms and policies.
  • We are not liable for any loss or damage arising from your use of third-party endpoints.

7.3 External Links

The Site may contain links to third-party websites or resources. We do not endorse and are not responsible for the content, products, or services offered by third parties.

8. Fees and Payment

8.1 Pricing

Access to certain features of the Service may require payment. Current pricing is available at https://koleslaw.ai/pricing. We reserve the right to change our pricing at any time, with at least 30 days’ notice for existing subscribers.

8.2 Billing

If you purchase a paid plan, you agree to pay all applicable fees. Fees are billed [monthly/annually] in advance and are non-refundable except as required by applicable law or as otherwise stated in these Terms.

8.3 Free Tier

If the Service offers a free tier, we reserve the right to modify, limit, or discontinue the free tier at any time without prior notice.

8.4 Usage Limits

Paid and free plans may include usage limits (such as the number of prompt enhancements per day or month). These limits apply across all interfaces — if you use the Site and the Extension under the same account, their usage counts toward the same limits. Current plan details and usage limits are available on the Site.

9. Service Availability and Modifications

9.1 Availability

We strive to maintain the availability of the Service but do not guarantee uninterrupted or error-free operation. The Site, the Extension, or the API may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. Scheduled maintenance windows will be announced on the Site when practicable.

9.2 Modifications

We reserve the right to modify, update, or discontinue any feature or aspect of the Service at any time. Because the Site and the Extension share the same backend, changes to the API may affect both interfaces simultaneously. If we make material changes that significantly reduce the functionality of a paid feature, we will provide at least 30 days’ notice to affected subscribers.

9.3 Extension Updates

The Extension may be updated through the Chrome Web Store. Updated versions may include changes to functionality, permissions, or data handling practices. Material changes will be reflected in updated Terms and/or Privacy Policy with appropriate notice.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES of merchantability, fitness for a particular purpose, and non-infringement.
  • WARRANTIES REGARDING OUTPUT QUALITY. We do not warrant that the Output will be accurate, complete, reliable, error-free, or suitable for any particular purpose. AI-generated content may contain factual errors, biased language, or inappropriate material. This applies equally to Output generated via the Site, the Extension, and the API.
  • WARRANTIES REGARDING AVAILABILITY. We do not warrant that the Service will be uninterrupted, timely, secure, or free from viruses or other harmful components.
  • WARRANTIES REGARDING CONSISTENCY. We do not warrant that the same input will produce the same Output across different sessions, interfaces, or time periods. AI model behavior may vary.

You acknowledge that you use the Service at your sole risk and that you are solely responsible for any consequences arising from your use of the Output.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • IN NO EVENT SHALL KOLESLAW, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service (through any interface), regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

  • OUR TOTAL AGGREGATE LIABILITY for all claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty US dollars ($50.00).

  • THESE LIMITATIONS APPLY to the fullest extent permitted by law, regardless of whether we have been advised of the possibility of such damages, and even if a limited remedy set forth herein is found to have failed of its essential purpose.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability and warranties are limited to the fullest extent permitted by applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Koleslaw and its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Service through any interface.
  • Your Content or your use of the Output.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.
  • Your violation of any rights of a third party.

13. Termination

13.1 Termination by You

You may stop using the Service at any time. You may delete your account by contacting us at [email protected] or through the account settings on the Site. If you use the Extension, you may uninstall it at any time, which will remove all locally stored Extension data. Uninstalling the Extension does not delete your account or any data stored on our servers — you must separately request account deletion if desired.

13.2 Termination by Us

We may suspend or terminate your access to the Service — across all interfaces — at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, extended inactivity, non-payment, or discontinuation of the Service.

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately across all interfaces. We will delete your data in accordance with our Privacy Policy. The following sections survive termination: Section 5 (Your Content), Section 6 (Intellectual Property), Section 10 (Disclaimer of Warranties), Section 11 (Limitation of Liability), Section 12 (Indemnification), Section 14 (Governing Law), and Section 15 (Dispute Resolution).

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict-of-laws principles. If you are a consumer in the European Economic Area, the United Kingdom, or Switzerland, this choice of law does not deprive you of the protection of mandatory provisions of the consumer protection laws of your country of residence.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any formal proceeding, you agree to attempt to resolve any dispute with us informally by contacting [email protected]. We will attempt to resolve the dispute within 30 days of receiving your notice.

15.2 Binding Arbitration

If the dispute is not resolved informally, you and Koleslaw agree to resolve it through binding arbitration administered by the American Arbitration Association (AAA) under its then-current rules, conducted in Atlanta, GA. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

15.3 Class Action Waiver

YOU AND KOLESLAW AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator shall not consolidate more than one person’s claims and shall not preside over any form of class or representative proceeding.

15.4 Exceptions

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction for claims related to intellectual property infringement or unauthorized access to the Service.

15.5 EU and UK Users

If you are a consumer in the European Economic Area or the United Kingdom, you are entitled to bring proceedings in the courts of your country of residence, and nothing in this section limits that right. You may also be entitled to use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional terms applicable to specific features of the Service, constitute the entire agreement between you and Koleslaw regarding the Service and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any provision shall be effective only if in writing and signed by an authorized representative of Koleslaw.

16.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, or third-party service failures.

16.6 Notices

Notices to you may be sent to the email address associated with your account or displayed on the Site. Notices to us should be sent to:

Thunk About It 3080 Monroe Way Alpharetta, GA 30004 United States of America Email: [email protected]

17. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Site with a revised “Last updated” date and, where practicable, by providing additional notice (such as an email, in-product notification on the Site, or an update notice in the Extension) at least 30 days before the changes take effect. Your continued use of the Service through any interface after the effective date of the revised Terms constitutes your acceptance of the changes.
